RE: The tariff classification of mini desk fans from China

Dear Mr. Crago:

In your letter dated June 9, 2008 you requested a tariff classification ruling. Descriptive literature and an illustration were submitted.

The products you plan to import are mini desk fans, item numbers W014BA09635 and W014BA09636. These desk fans are comprised of metal and plastic. The front and rear grills are made of metal and the fan blades and bases are made of plastic. The fan blades are axial in design. Item number W014BA09635 uses only two “AA” batteries to power the fan. Item number W014BA09636 is powered by two “AA” batteries or an AC/DC adapter that is packaged together with the fan.

The applicable subheading for the mini desk fans will be 8414.51.9090, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other table fans with a self-contained electric motor not exceeding 125W. The rate of duty will be 4.7 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
